“[I]nstead of offering particular person reduction to the victims of Defendants’ predatory scheme, the settlement settlement seems supposed to topic them to heightened surveillance, and, for some, may topic them to potential detention, household separation, and even deportation,” the temporary states.

Representatives for Colony Ridge and the Shopper Monetary Safety Bureau (CFPB) didn’t instantly reply to HousingWire’s requests for remark.

A spokesperson for the Division of Justice (DOJ) declined additional remark past the company’s preliminary information launch. Assistant Lawyer Normal Harmeet Okay. Dhillon of the Civil Rights Division mentioned within the launch that “the adjustments required by this settlement will promote public security, and reasonably priced and sustainable homeownership in America, key priorities of this Administration.”

The coalition — led by the Nationwide Honest Housing Alliance (NFHA) and likewise comprised of the League of United Latin American Residents, Middle for Accountable Lending, Nationwide Shopper Regulation Middle, UnidosUS, the Poverty & Race Analysis Motion Council, Public Justice and the Southern Poverty Regulation Middle  — filed an amicus temporary on Wednesday urging the court docket to reject the deal.

Of their submitting, the teams argue that asking the court docket to retain jurisdiction to implement the settlement is “improper and illegal” as a result of the immigration and regulation enforcement provisions are unrelated to the underlying truthful lending claims.

In December 2023, the DOJ and CFPB sued Colony Ridge. They alleged the corporate operated an unlawful land gross sales scheme and made false statements to tens of hundreds of Hispanic borrowers in Texas, in violation of the Honest Housing Act and the Equal Credit score Alternative Act. The Texas Workplace of the Lawyer Normal (OAG) filed an analogous lawsuit in 2024.

Federal businesses alleged that Colony Ridge used deceptive gross sales techniques — together with misrepresentations about flooding risks — and didn’t confirm debtors’ skill to repay, contributing to elevated foreclosures charges.

“The proposed settlement doesn’t compensate the individuals or communities that have been harmed by the predatory insurance policies and actions of this developer,” mentioned Mitria Spotser, vice chairman and federal coverage director on the Middle for Accountable Lending.

Odette Williamson, director of racial justice advocacy on the Nationwide Shopper Regulation Middle, added that “cash that ought to go to victims is as an alternative being proposed for immigration enforcement, subjecting victims to elevated threat of deportation.”
